The rules for playing SWADE, in plain words. By using the app, you agree to them.

Who we are

SWADE is a fitness game for iPhone and Android that needs a phone with a camera: your body is the controller. It is published by SWADE SAS, a French simplified joint-stock company with a share capital of 500 €, registered under RCS Paris 995 047 495, at 200 rue de la Croix Nivert, 75015 Paris, France. Everything else about us is in the legal notice.

You need to be 15 or older

SWADE is for players aged 15 and up. Under 18? Ask a parent before you subscribe to Premium.

Move safely

You jump, squat and step for real. SWADE is a game, not a medical service, and nothing it shows you is medical advice.

  • Clear the space around you first: furniture, cups, pets, other people. Keep your feet on a floor that doesn’t slide.
  • Any doubt about exercising, like a heart condition, an injury, a pregnancy or a treatment? Ask a doctor before you play.
  • Something hurts? Stop right away.
  • Go easy on your knees or your back: in Settings › Health, pick what to protect, and jumps come out of every session.

Your camera stays on your phone

The game reads your moves through your phone’s camera, and the tracking runs on the phone. No image, no video, not a single frame ever leaves it. Only your moves travel: a jump, a squat, a score. Our privacy policy says what we keep, and why.

Your account

You can play without an account. Create one, with Apple, Google or your email, to keep your progress on another phone. Keep your sign-in to yourself: you answer for what is done with it, unless you’ve told us it was stolen.

You can delete your account whenever you like, in the app or by email: here’s how.

Free, and Premium

SWADE is free to play. Each game costs energy, which refills over time, and the day’s session stays free even with an empty tank.

SWADE Premium is a subscription. It gives you unlimited energy, unlimited streak freezes with automatic repair, and new games for Premium first as they come out. It comes monthly or yearly.

  • The App Store or Google Play sells it and bills it, under its own terms. The price is the store’s, shown in the app before you pay.
  • When the store offers it to you, the yearly plan starts with 14 days free. Unless you cancel at least 24 hours before they end, the store then bills the year.
  • Your subscription renews by itself for the same period, at the same price, until you cancel it.
  • Changed phones? Sign in with the same store account and tap Restore purchases.

Cancel, and get your money back

Cancel anytime, up to 24 hours before your subscription renews, in your App Store or Google Play subscriptions. In the app, Settings › Manage subscription takes you there. Premium then stays on until the end of the period you paid for.

Deleting the app or your account doesn’t cancel your subscription: the store bills it, so you cancel it there.

If you live in the EU, you have 14 days after your purchase to withdraw, unless you asked the store to start Premium right away and accepted to lose that right. Refunds, then and later, are the store’s: ask for them from your purchase history. Stuck? Write to us.

Play fair

  • Play with your own body. No tricks to fake moves, scores or streaks, and no bots.
  • Don’t copy, modify or take apart the app, beyond what the law lets you do.
  • Don’t attack our servers or use them for anything but the game.
  • Don’t use the app to break the law or harm anyone, and don’t point the camera at people who didn’t agree to it.

When it ends

You can stop whenever you like: cancel Premium, delete your account, uninstall the app.

If you seriously or repeatedly break these terms, we can suspend or close your account. We tell you why first and let you answer, unless the law stops us or the abuse has to end right away.

We keep improving SWADE: games come, go or change. If we ever stop SWADE or Premium, we tell you in advance, and you can ask for a refund of the time you paid for and won’t get.

What’s ours

SWADE, Sway, the games, their look, their sounds and their code belong to SWADE SAS. We give you a personal right to use the app to play, not to sell it or reuse it elsewhere. Your scores and your progress stay yours.

If something goes wrong

We work to keep SWADE running, but it can pause for an update or a fault. We answer for the harm our own fault causes you, as French law says. We don’t answer for what comes from not following these terms or the safety rules above, from a phone or a connection that fails, or from an event out of anyone’s control.

None of this takes away a right the law gives you. As a consumer, you have the legal guarantee of conformity for digital content and services (French Consumer Code, article L224-25-12 and following): an app that doesn’t work as promised is fixed, or you get your money back.

When these terms change

We may update these terms, and the date at the top says when. A change that matters to you, we tell you in the app before it applies. Don’t agree? You can stop and cancel before it does.

The law that applies

These terms are under French law. Living in another country, you keep the protection its consumer law gives you, and you can go to the courts where you live. Before any of that, write to us: most things sort out with a message.
